To say one of DC or Marvel is more thematic over the other really is not a fair argument. Everyone has their own idea of what makes one "thematic" and other people just like to play games.I love both games but DC just makes it to the table 10x more b/c in the time you can set up and play 1 game of Legendary you could play 3-4 of DC.
The thing the OP says about the middle refilling...

Well if you are doing this then you should be defeating the super villain. Sure these turns happen rarely that you are still defeating him and then buying the center row, but that should be very end game.
See the reason why they did not let you go fishing, is b/c it's way to easy to fish and get some OP lower powered cards and also buy a 2 power when you have say 6 or 7 just to find that Green Arrow. Not only will it unbalance the game it lengthens it as well. Then you take away the pure simplicity and speed that is DC DBG.
BUT as i think someone above said you can simply play the "on Patrol" variant in the rulebook if you want to fish.
Onto one of my favorite arguments about deckbuilders which typically comes from newer or IMO lesser skilled deckbuilding players.
The dominant strategy in this game is just to buy the biggest things that give you the most power to buy more things. That's the whole game, and once the players have figured that out, the game becomes all about the luck of who gets to have access to the best things on their turns.
Sometimes this is true and generally when you get over a certain price of a card it's almost always true. BUT when you subscribe to this in every game you play you will lose. The good players have their card hierarchy in their head and they know when some cards are just going to mesh with others or just plain better then getting one b/c it has a couple more power to it. So sure in some cases you are right super strength is almost always the best buy or defeating a super villain is almost always the better play. But remember this isn't an 18XX game it's not supposed to be too complex and too long.

And like most said to each his own, but I think there are flawed arguments out there. People should think outside the box before calling a game "horrible" or "terrible"
