Well, perhaps a year makes a difference. Although, the biggest challenge is "sitting still" for the 3 year old as well. I'm not sure what your Nephew enjoys, but when my 3 YO has expressed interest in a game, I have attempted to "play" in a manner that they could enjoy.
I had out some Rocketmen Miniatures one time, and she said she wanted to play "The rocket game." So, I made up a little race game with the models and a "battle" when they got near some enemy Rockets. We rolled dice for movement spaces and she had a good time.
Besides actually playing DC Deckbuilder as it was intended, we also played a number matching game--she "won" cards by matching the numbers on her cards to revealed cards.
Kids (pretty much all of them) that are used to immediate and consistent flow of information (sounds and lights) aren't likely to "get" something with intervals as easily.
"Sorting" I think is also common. I've noted that 3YO is favoring some cards (like Suicide Squad and Bizarro in both games), and also yesterday, she bought multiples of 'Cape and Cowl' and the 'Bat Signal'. Wonder Woman cards were also of great interest, and she loves Zatanna. But other times, she will take a "Kick" card as well.
